This website is operated by Holt Product Development, doing business as The Duct Tape Method™ (“The Duct Tape Method,” “we,” “us,” or “our”).

The Duct Tape Method offers this website, including all information, content, features, tools, products, and services available through the website (collectively, the “Services”), subject to your acceptance of these Terms of Service (“Terms”).

By visiting our website, purchasing a product from us, creating an account, submitting information, or otherwise using the Services, you agree to be bound by these Terms and by any additional policies referenced in or linked through the Services, including our Privacy Policy, Shipping Policy, and Return and Refund Policy.

Our store is hosted by Shopify Inc. Shopify provides the ecommerce platform that enables us to offer our products and Services to you.

We may limit quantities purchased per customer, household, account, payment method, billing address, shipping address, or order.

Product descriptions, package quantities, dimensions, materials, pricing, and availability may be changed from time to time.

No description, photograph, educational material, customer review, article, social-media content, or other statement should be interpreted as creating a warranty or guarantee unless expressly identified by us as a warranty.


SECTION 6 — ORDERS, PRICING, BILLING AND PAYMENT

Prices for our products are subject to change without notice.

Prices will be displayed in the currency identified at checkout. Applicable taxes, shipping charges, duties, brokerage fees, currency-conversion charges, and other amounts, where applicable, will be disclosed or calculated as required before completion of the transaction.

We reserve the right to reject, limit, or cancel an order where permitted by law, including where:

  • a product is unavailable;
  • pricing or product information contains a material error;
  • payment cannot be authorized;

  • shipping to the requested destination is unavailable.

If payment has already been collected for an order we cancel, we will issue any refund required under applicable law and our published policies.

You agree to provide current, complete, and accurate purchase and account information for all transactions and to promptly update information necessary to complete your transaction.

Your submission of an order constitutes an offer to purchase. An order is not necessarily accepted merely because an automated order confirmation has been generated. We reserve the right to accept or decline an order subject to applicable consumer-protection law.

SECTION 7 — SHIPPING, DELIVERY, RETURNS AND REFUNDS

Shipping availability, estimated delivery times, shipping charges, and applicable restrictions are described during checkout and/or in our Shipping Policy.

Delivery dates and transit times are estimates unless expressly stated otherwise.

The Duct Tape Method products are non-medicated adhesive products.

The Services may contain links to websites, research, publications, social-media platforms, payment providers, shipping providers, or services operated by third parties.

We do not control third-party websites or services and are not responsible for their content, security, availability, privacy practices, statements, products, or services.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL THE DUCT TAPE METHOD, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DUCT TAPE METHOD, HOLT PRODUCT DEVELOPMENT, AND OUR AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SERVICES OR PRODUCTS, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR SIMILAR ECONOMIC LOSS.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR LOSS OR DAMAGE CAUSED BY MISUSE OF A PRODUCT, USE CONTRARY TO PRODUCT DIRECTIONS OR WARNINGS, UNAUTHORIZED MODIFICATION OF A PRODUCT, OR FAILURE TO TAKE REASONABLE PRECAUTIONS.

  2. your unlawful use of the Services;
  3. your violation of the lawful rights of another person; or
  4. content or Feedback you submit in violation of these Terms.

This indemnification obligation does not apply to the extent a claim was caused by our own conduct for which liability cannot legally be excluded or transferred.

We may assume control of the defence of an indemnified claim where reasonably necessary, and you agree to provide reasonable cooperation.


SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and, where necessary, the unenforceable portion will be severed.
